Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Plany

mobile app, the website at https://plany.travel, and any related services

(collectively, the "Service"), operated by Loopsware, SA a company

("Plany", "we", "us", or "our").



By creating an account, downloading the app, or otherwise using the Service,

you agree to these Terms and to our Privacy Policy at

https://plany.travel/privacy. If you do not agree, do not use the Service.

## 1. Eligibility



You must be at least 13 years old to use the Service (or the minimum digital

consent age in your jurisdiction, whichever is higher). If you are between

13 and the age of majority where you live, you may use the Service only

with the consent of a parent or legal guardian.



The Service is not directed to children under 13. If we discover that a

user is under 13, we will close the account and delete the associated data.



## 2. Your Account



To use most features of the Service, you must create an account using a

supported sign-in provider (currently Google or Apple). Authentication is

handled by our identity provider, Clerk.



You are responsible for:



- the activity that occurs under your account;

- keeping the credentials of your sign-in provider secure; and

- promptly notifying us of any unauthorized use at

[support@plany.travel](mailto:support@plany.travel).



We may suspend or terminate your account if you violate these Terms,

abuse the Service, or use it in a way that harms us or other users.



## 3. The Service



Plany helps you plan trips by:



- generating AI-assisted travel itineraries based on a destination, dates,

and preferences you supply;

- saving locations ("spots") you find on social platforms;

- collecting visited-country and trip "stamps";

- letting you share trips with other people via a link.



We may add, change, suspend, or remove features at any time, with or

without notice.



## 4. Plany Pro Subscription



Some features of the Service ("Pro Features") require a paid subscription

("Plany Pro"). Subscriptions are billed and managed by the Apple App Store

or Google Play, not by Plany directly. By subscribing you also accept the

applicable App Store or Play Store terms.



### 4.1 Billing and Auto-Renewal



- Subscriptions are sold as auto-renewing monthly or yearly plans at the

price displayed at purchase.

- Your subscription will automatically renew at the end of each billing

period unless you cancel at least 24 hours before the end of the current

period.

- The applicable store (Apple ID or Google account) will be charged for

the renewal within 24 hours before the end of the current period.



### 4.2 Free Trial



If a free trial is offered, you will not be charged during the trial

period. If you do not cancel before the trial ends, the subscription will

begin and you will be charged at the standard price.



### 4.3 Managing or Cancelling



You can manage or cancel your subscription at any time in your

device's subscription settings:



- **iOS:** Settings → [your name] → Subscriptions → Plany

- **Android:** Google Play app → Profile icon → Payments & subscriptions

→ Subscriptions → Plany



Cancelling stops future renewals but does not refund the current period.



### 4.4 Refunds



Refund requests are handled by Apple or Google according to their

policies. We do not process refunds directly.



### 4.5 Price Changes



We may change subscription prices for future billing periods. We will

notify you in advance and you will have the opportunity to cancel before

the new price applies.



## 5. Your Content



You retain all rights in the content you create through the Service,

including trips, saved spots, stamps, photos, and chat messages

("Your Content").



By submitting Your Content you grant us a worldwide, non-exclusive,

royalty-free license to host, store, reproduce, and display Your Content

solely so we can operate and improve the Service for you. This license

ends when you delete Your Content or your account, except where we are

required by law to retain a copy.



### 5.1 Shared Trips



If you generate a public share link for a trip, anyone who has the link

can view that trip until you disable sharing or delete the trip. Trips

shared with others remain in their accounts (as a view-only copy) even

if you later delete the original.



### 5.2 Imported Content



Plany lets you import spots from third-party platforms (currently

TikTok, Instagram, and YouTube) via shared links. We do not own that

content and we do not store the original videos or images. You are

responsible for ensuring you have the right to import a link, and for

complying with the third-party platform's own terms.



## 6. AI-Generated Content



Itineraries, suggestions, descriptions, and chat responses produced by

the Service are generated by automated systems including large language

models. These outputs:



- may be inaccurate, incomplete, or out of date;

- are not a substitute for professional travel, medical, safety,

immigration, or legal advice; and

- should be independently verified before you act on them, especially

for opening hours, prices, visa requirements, safety conditions, and

border or health regulations.



You are solely responsible for the decisions you make based on

AI-generated output.



## 7. Acceptable Use



You agree not to:



- use the Service in violation of any law;

- attempt to reverse-engineer, scrape, or interfere with the Service or

its underlying infrastructure;

- upload content that is illegal, infringing, defamatory, hateful,

sexually explicit, or that exploits minors;

- use the Service to harass, abuse, or impersonate others;

- introduce malware, automated agents, or any code intended to harm the

Service or other users;

- resell, sublicense, or commercially exploit the Service without our

prior written consent.



We may remove content or terminate accounts that violate this section.



## 8. Third-Party Services



The Service relies on several third-party providers, including but not

limited to: Apple App Store, Google Play, Clerk (authentication),

RevenueCat (subscription management), Mapbox (mapping), and providers of

the AI models that power our itineraries and chat. Your use of the

Service is also subject to the relevant terms of those providers. We are

not responsible for the practices of any third-party service.



## 9. Intellectual Property



Plany, the Plany logo, the app design, the source code, and all

non-user-supplied content are owned by us or our licensors and are

protected by intellectual-property laws. Nothing in these Terms

transfers any of those rights to you.



## 10. Account Deletion and Termination



You can permanently delete your account at any time from inside the app

(Profile → Account → Delete Account). Deletion is irreversible and

removes:



- all saved trips, spots, stamps, and chat history;

- your sign-in identity in our authentication provider; and

- your subscription association with the account (cancel any active

subscription separately in the App Store or Play Store as described

in Section 4.3).



Trips you previously shared with other users remain in their accounts.



We may suspend or terminate your account at any time if you breach

these Terms or applicable law, or if continuing to provide the Service

to you would expose us to legal or operational risk.



## 11. Disclaimers



The Service is provided **"as is" and "as available"** without warranties of

any kind, whether express or implied, including the implied warranties of

merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:



- the Service will be uninterrupted, timely, secure, or error-free;

- itineraries, place details, prices, opening hours, or any other

information surfaced by the Service is accurate or current; or

- the Service will meet your travel-planning expectations or that any

travel undertaken based on the Service will be safe or successful.



Travel involves inherent risks, including but not limited to weather,

health, crime, political instability, and changes in border, visa, or

health policy. You alone are responsible for assessing those risks and

for your own safety while travelling.



## 12. Limitation of Liability



To the maximum extent permitted by law, in no event will Plany, its

officers, directors, employees, or agents be liable for any indirect,

incidental, special, consequential, or punitive damages, or any loss of

profits, revenue, data, goodwill, or trip-related expenses arising out of

or in connection with your use of the Service, whether based on

contract, tort, statute, or any other legal theory, even if we have

been advised of the possibility of such damages.



Our aggregate liability for any claim arising out of or relating to

these Terms or the Service will not exceed the greater of (a) the

amount you paid to us for the Service in the 12 months before the event

giving rise to the claim, or (b) USD 50.



Some jurisdictions do not allow the limitation or exclusion of certain

warranties or damages, so the above limitations may not apply to you.


to conflict-of-laws principles. The exclusive venue for any dispute

arising out of or relating to these Terms or the Service will be the

courts located in [VENUE], and you consent to the jurisdiction of those

courts.



Nothing in this section affects any non-waivable consumer rights you

may have under the law of your country of residence.
